Copyright & DMCA Takedown Policy

1. Overview

Red Mile Records Inc. respects the intellectual property rights of others and expects all users of our website and services to do the same. This policy describes our procedures for responding to claims of copyright infringement under the Digital Millennium Copyright Act (17 U.S.C. § 512) ("DMCA") and in alignment with Canada's Copyright Act (RSC 1985, c C-42) and the Notice and Notice regime established under the Copyright Modernization Act (SC 2012, c 20).

Note on Canadian jurisdiction: Red Mile Records Inc. is a Canadian corporation operating under Alberta law. While the DMCA is a United States law, we adopt DMCA-aligned procedures as an international best practice for responding to copyright complaints globally. In Canada, the Copyright Act and the "Notice and Notice" regime govern copyright takedown obligations for Canadian internet service providers. We comply with both frameworks where applicable.

3. How to Submit a Takedown Notice

If you believe that content on our website (www.redmilerecords.com) infringes your copyright, you may submit a written takedown notice to our Designated Agent. To be legally valid under the DMCA (17 U.S.C. § 512(c)(3)), your notice must include all of the following elements:

  1. Identification of the copyrighted work: A description of the copyrighted work you claim has been infringed, or, if multiple works on our site are covered by a single notification, a representative list of those works.
  2. Identification of the infringing material: A description of the material you claim is infringing and information reasonably sufficient to permit us to locate the material on our website. Providing the specific URL(s) is strongly preferred.
  3. Contact information: Your full name, mailing address, telephone number, and email address so that we may contact you.
  4. Good faith statement: A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. Accuracy statement: A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner, or are authorized to act on behalf of the copyright owner.
  6. Signature: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

Important: Notices that are materially incomplete or that misrepresent facts may expose the submitting party to liability for damages, including costs and legal fees, under section 512(f) of the DMCA or equivalent Canadian law. Please ensure all required elements are included before submitting.

Send completed takedown notices to the Designated Agent by email or mail as listed in Section 2.

4. Our Response to Valid Notices

Upon receiving a valid, complete takedown notice, Red Mile Records Inc. will:

  1. Promptly remove or disable access to the allegedly infringing content from our website.
  2. Make a reasonable attempt to notify the person who posted the content (if applicable) that the content has been removed and the reason for removal.
  3. Provide the alleged infringer with information about the counter-notice process described in Section 5.

We will respond to valid notices as quickly as reasonably practicable, generally within five (5) to ten (10) business days of receipt.

5. Counter-Notice Process

If you believe that content removed from our website as a result of a takedown notice was removed in error — for example, because you are the content owner, you have a licence to use the content, or the use constitutes fair dealing under the Canadian Copyright Act — you may submit a counter-notice to our Designated Agent.

A valid counter-notice must include all of the following elements (pursuant to 17 U.S.C. § 512(g)(3)):

  1. Your contact information: Your full name, mailing address, telephone number, and email address.
  2. Identification of the removed material: A description of the material that was removed and the location on the website where it appeared before removal (i.e., the original URL).
  3. Statement of good faith belief: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Jurisdiction consent: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, for Canadian submitters, a statement that you consent to the jurisdiction of an appropriate court in Alberta, Canada), and that you will accept service of process from the person who submitted the original takedown notice or their agent.
  5. Signature: Your physical or electronic signature.

Send completed counter-notices to the Designated Agent at the contact information in Section 2. Upon receipt of a valid counter-notice, we will forward it to the original complainant. If the complainant does not initiate legal action within ten (10) business days, we may, at our discretion, restore the removed content.

6. Repeat Infringer Policy

In accordance with the DMCA and our commitment to respecting intellectual property, Red Mile Records Inc. maintains a policy of terminating, in appropriate circumstances, the accounts or access of users who are found to be repeat infringers. We define a "repeat infringer" as any user who has been the subject of two (2) or more valid, uncontested DMCA takedown notices in a rolling twelve (12) month period.

Red Mile Records Inc. reserves the right to:

  • Immediately and permanently ban any repeat infringer from using our website or services without notice or refund.
  • Remove all content associated with a repeat infringer's account.
  • Report repeat infringement activity to applicable authorities where required by law or deemed appropriate.

7. Alignment with Canadian Copyright Law

While this policy uses DMCA terminology as an international standard, Red Mile Records Inc. also complies with the Canadian Copyright Act (RSC 1985, c C-42) and the "Notice and Notice" regime under the Copyright Modernization Act (SC 2012, c 20). Under the Notice and Notice regime, internet service providers in Canada are required to forward copyright notices from rights holders to subscribers who are alleged to have infringed copyright.

Copyright in Canada generally protects works for the life of the author plus fifty (50) years. Canadian fair dealing provisions (under section 29 of the Copyright Act) permit the use of copyrighted material without permission for purposes including research, private study, education, parody, satire, criticism, review, and news reporting, provided the use is "fair." Whether a particular use constitutes fair dealing depends on the specific facts.
